Story

The Supreme Court of the land in the person of his eminence, the Chief Justice, told the states that it was perfectly within the law to discriminate against people like us. Based on the Alabama decision and several others, civil rights at the federal level for the disabled has become a joke.

As someone who has worked in the field of law for years, I am aware of how much sway a decision of this magnitude has on the very attitude of the courts toward the target of the law. The states no longer have to make their buildings accessible; almost any kind of rational which the states want to use can be used to deny access to the disabled. The word is out across the land that discrimination against the disabled is perfectly legal and appropriate, if it is based on a whim (the nature of which the states can freely determine).

This attack on ADA's Title I is just the tip of the iceberg because the same people who always fought the ADA will be coming back every six months or year for more change. President Bush can use all the pretty words he wants to use, but this still stinks and his attitude and the attitude of the people who work for him toward civil rights for disabled people stink.

My boogie man is then the Supreme Court and the havoc it is raining down on the heads of the people I advocate for. Many of us fought long and hard for the ADA, and we have also fought just as long and as hard to see it implemented into daily life in America.

If, as it seems increasingly likely, we cannot win in court, we need to stage our battle in the hearts and minds of the population of this great country. The people who run the government today are poised to unleash a unified and well directed attack on many organs of government which sustains the body disabled. Politicians are constantly looking for a scapegoat to blame for the havoc their programs reap on the heads of the population. There are billions of dollars going into transfer payments for the disabled. This will become a tempting target of budget cutters if, as expected, the tax cuts don't produce the bonanza in growth or economic development.

We need ideas and fresh approaches to find solutions to problems which have been with us for centuries. There are a few mouth organs of the disabled community that verbalize the need for action, but most of the disabled out there sit on their hands when called to action.

In conclusion, the Supreme Court's decision on Title I is very important. We people with disabilities now have no standing against the federal government over discrimination as practiced by state government. Who knows what will come next as we wait for the next ruling?
