DECEMBER PRESS RELEASE Volume VII NO.I WINTER 1997

MISSION STATEMENT The Association for Disabled Americans’ (ADA) purpose is to initiate access and compliance with the Federal "ADA", Florida Statutes 553 and 316, and the South Florida Building Code, to protect the interests of individuals with disabilities. This Association is open to all persons with a disability. The goal is to promote compliance through education, and when necessary (often), litigation. To date, the ADA, along with the FPA( Florida Paraplegic Association) and named individuals, have been involved in over 190 civil suits. None have gone to trial! All have been settled, dismissed, or are in negotiations for settlement. Barriers at common entrances and other significant violations are given priority when formal complaints are being developed. Call, write, or fax in your complaint! Anonymous complaints accepted. Those with the most complaints receive higher prioritization. All notices served are from formal complaints given by Florida residents. You can better serve the community to reach total accessibility for all Americans with disabilities. YOU help to find and change the locations. While the Association has brought over 190 law suits, these suits can only seek compliance and not punitive damages, except when stipulation agreements are violated. Legal representation is on a contingency basis by more than six different firms. Plaintiff attorney costs and fees are paid by the defendants. Unfortunately, four settlements have already been submitted to the courts for enforcement. Penalties have been received from a hotel and a theater. Membership continues to expand, as well as recognition of the common cause. Activities only increase as individuals become involved to achieve the goal of access for all! Time frames for settled cases generally require modifications within a six month period of time. There are exceptions for defendants experiencing financial hardships or who meet more than the minimal standards. Please, let us know if and when you’re available to visit various locations, especially since penalties are being assessed by the courts for non-compliance. Penalties revert to the ADA and are used to further the cause of bringing about equal access for everyone! Below, is a list of suits brought to date. Complaints currently exceed 20 locations to be investigated. The activities are seen as advantageous to all entities and people to promote equality, unity and justice for all! As efforts gain momentum, the calls, faxes and complaints, continue to increase from broader and broader areas. From Key West through Orlando to Tallahassee. Questions are constantly asked about specific requirements, barrier removal, and information on locations which have passed inspections and are compliant. Such a database would be invaluable to our community. In that vein, a solicitation is made for the donation of a web page and/or a simple publication to include accessible facilities, links to other organizations and documentation for compliance. Interested entities are implored to step forward in advancing visibility and dissemination of information. Your philanthropy will help many. Please contribute towards advancing the cause. The Association’s efforts are concentrating on larger facilities such as schools, hospitals, and theaters. The goal is for efforts to be seen as a positive advancement for everyone. A win win win! A capital improvement, tax credit, and access for more patrons. Other groups or individuals wishing to include themselves or recommend others as named plaintiffs are always considered. Membership is extended to any individual with a disability. Please include yourself to receive newsletters and participate in advancing access. Orlando is on the list for inspections followed soon by Tallahassee. It won’t be long before the efforts have been seen by most of Florida. Complaints are being received every week and will be investigated. Got a restaurant with a restroom you can’t use? Simply complete the attached complaint form. There is a good chance some suits will be filed in the near future based solely on lack of availability of a TDD at banks of 4 or more phones, for the Deaf and hard of hearing, cruise lines & air carriers are also being considered. Recently the Association for Disabled Americans Inc. ( ADA) has gone under several changes. Edward Resnick has resigned from the Presidency position in order to begin suits as an Attorney rather than plaintiff. James Parrish will be decreasing some involvement, resigning from the secretary position but remaining as treasurer. Mildred Levinson, Director, has turned in her resignation, to devote more time on FPA. As of this report the Secretary position has been filled by Steven Riley, and Attorney Andrew Batavia has now received appointment in the new director position. Updates on other positions changes will be in future newsletters. Not that many years ago, there was very little accessibility for the disabled. It was not until the Americans with Disabilities Act (ADA) was passed in to law, that the disabled had the new legal rights to take on the establishment which has been ignoring the accessible needs in public accommodation requirements as spelled out by the ADA. The advancement of technology especially in the field of computers has greatly increased the independence for the community of disabled and increased job opportunities. The ADA has opened a whole new world for the disabled . The physically challenged with the aid of wheelchairs and other assistive devices could only go so far. Now through the ADA, and continued hard work, accessible modes of transportation and public accessibility are being made available. Now some people think that there are a lot more disabled people ,however, the fact is we have always been here. It wasn’t until the ADA the disabled had very few ways of going places and even fewer ways of getting in places such as restaurants, hotels etc. Numbers are increasing, and so is our visibility. The disabled are becoming a vital part of the job market and important members of the community. Take a look at our President, recently with a mobility impairment and now the second President who is hard of hearing. This has been a long battle and we still have a long way to go.
