Someone out there please HELP! I just moved to Virginia state, which was No easy task. I'm disabled; I have been disabled for more than ten years. I parked a small, fifteen foot powerboat directly in front of my home "on-street" -- a public street. It's not in anyone's way.
On November 8th, 1999 a Community Maintenance Inspector served me with a NOTICE which stated I was in violation of a Henrico County Code, Section 24-102(2) -TRAILERS. After reading the NOTICE and alleged violation I proceeded to call the Community Maintenance Supervisor. I explained that the NOTICE was wrong! I explained that I am disabled , and felt that the NOTICE served to me was NOT applicable due to my situation.
The supervisor questioned me as to what my disability was, and the specifics thereof. The supervisor said that he would appeal to the Henrico County Attorney and get back to me. Thereafter, the supervisor called me and requested that I send him a letter covering my concerns of accessibility with reference to my powerboat parked in front of my home, any hardship posed by moving it, and disability. The supervisor said he would forward my letter to the county attorney upon receipt, and that perhaps some variance would be granted.
Once again I complied and mailed my letter as instructed. I sent it via Certified Mail. On the morning of Wednesday, November 24th, 1999, I received a telephone message from the supervisor: Whereas he requested an appointment for both the inspector and himself to "observe" my property, and so that I could "demonstrate" the situation with the boat to them along with my need for on-street parking. Message saved. When I returned the supervisors message I reminded him that I had already sent the letter he requested, and questioned what was needed to remain parked on -street? The supervisor replied that a meeting was a necessary part of the process and he requested an appointment for eleven o'clock.
In the interest of resolving the matter I agreed to meet with them, and that they could observe the site. However, I would NOT be putting on any "demonstration" as requested! During the meeting a number of picture(s) were taken of my home, my boat, and myself included. No mention was ever made of taking pictures or the need for them. No one ever asked for permission to take pictures, nor did anyone ever explain the poupose for taking so many pictures. Additionally, measurements of the entire front of my property were also taken as well.
During the meeting the supervisor asked me a series of questions that were becoming increasingly offensive and off topic. I was asked the following questions: 1). Have I used the boat? 2). Where did I use the boat? 3). Has it been used since I moved to Virginia? 4). How often do I use the boat? 5). Do I drive the boat? 6). Who backs the boat down boat ramps? 7). Do I drive my automobile? 8). My ability to drive a vehicle was even questioned? The issue is accessibility related to the parking of a boat-trailer, TRAILER. At that time I "protested" against the line of questioning and rudeness! Needless to say by that point I concluded the meeting.
I was outraged and very upset, mostly with the supervisors ignorance. I asked the supervisor for the name and phone number of his superior. I then called his superior, "the manager." "The Henrico County Code Section 24-102(2) -Trailers makes NO provision or consideration for people with disabilities." It's outdated and discriminates! I only want to be able to access my boat with trailer by the easiest and most practical route possible. I want to remain parked in front of my home, on-street. By allowing me to remain parked on-street I could more easily load and unload, maintain, depart and repark from that location. The county is unconcerned with my handicap needs, they want the boat moved. The reply I received said: "In my research of the ADA Act, I have not discovered any authority for the proposition that disabled individuals do not have to comply with local zoning ordinances in a situation such as yours."
